1. Acceptance of Terms

By accessing or using the Welinkup platform ("Service"), available at https://welinkup.com (the "Website") and

related applications, you ("User", "you", "your") agree to be bound by these Terms and Conditions ("Terms"). If

you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and Welinkup ("Company", "we", "us", "our").

By creating an account, connecting a Meta Ads account, or using any feature of the Service, you acknowledge

that you have read, understood, and agree to be bound by these Terms.

If you are using the Service on behalf of a business, organization, or other entity, you represent and warrant

that you have the authority to bind that entity to these Terms, and "you" and "your" will refer to that entity.

2. Description of Service

Welinkup is a Meta Ads automation platform that enables users to create, manage, and analyze Facebook and

Instagram advertising campaigns. The Service includes, but is not limited to:

3. Eligibility

4. Account Registration and Security

4.1 Account Creation

To access the Service, you must create a Welinkup account by providing accurate, current, and complete

information. You agree to update this information to keep it accurate.

4.2 Meta Account Connection

To use the campaign creation and management features, you must connect your Meta Ads account to

4.3 Account Security

Share your campaign data with other Welinkup users or third parties, except as described in our

7.1 Third-Party AI Providers

8. Payment Terms

8.1 Subscription Plans

Welinkup offers subscription-based access to its features. By subscribing to a paid plan, you agree to pay the

fees associated with the plan you select. Pricing details are available on our pricing page at

https://welinkup.com/pricing.

8.2 Payment Processing

Payments are processed through third-party payment processors (Stripe and/or Lemon Squeezy). By providing

payment information, you agree to the terms of service and privacy policies of the applicable payment

processor. Welinkup does not store credit card numbers or bank account details on its servers.

8.3 Billing Cycle

Subscriptions are billed on a recurring basis (monthly or yearly, depending on the plan selected). Your

subscription will automatically renew at the end of each billing period unless you cancel before the renewal

date.

8.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain

access to paid features until the end of your current billing period. No refunds will be provided for partial billing

periods, unless required by applicable law.

8.5 Advertising Spend

Welinkup subscription fees are separate from any advertising spend on Meta platforms. You are solely

responsible for all ad spend incurred through your Meta Ads account, which is billed directly by Meta. Welinkup

has no control over and assumes no responsibility for Meta advertising charges.

9. Intellectual Property

9.1 Welinkup’s Intellectual Property

The Service, including its software, design, features, documentation, and all related intellectual property rights,

is owned by Welinkup or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable

license to use the Service in accordance with these Terms.

9.2 User Content

You retain ownership of all content you upload or create through the Service, including ad creatives, copy, and

campaign configurations. By using the Service, you grant Welinkup a limited license to use, display, and

process your content solely for the purpose of providing the Service.

9.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service may be used by Welinkup without any

obligation to compensate you.

10. Data Retention and Deletion

Welinkup retains your data for as long as your account is active or as needed to provide the Service. Upon

other harmful components.

11.2 Meta Platform Dependencies

The Service depends on the Meta Marketing API and Meta’s advertising platform. Welinkup is not responsible

for:

To the maximum extent permitted by law, Welinkup’s total liability for any claims arising from or related to the

Service shall not exceed the total fees paid by you to Welinkup in the twelve (12) months preceding the claim.

In no event shall Welinkup be liable for any indirect, incidental, special, consequential, or punitive damages,

including loss of profits, data, or business opportunities.

Downtime, changes, or disruptions to Meta’s API or advertising platform.
Changes to Meta’s policies, terms, or API specifications that may affect the Service.
Ad rejections, account restrictions, or other actions taken by Meta on your advertising account.
Inaccuracies in data provided by Meta’s API.

12. Indemnification

You agree to indemnify, defend, and hold harmless Welinkup, its officers, directors, employees, and agents

from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

Your violation of these Terms.
Your violation of any applicable law, regulation, or third-party rights.
The content of your advertising campaigns.
Your violation of Meta’s terms, policies, or advertising standards.

13. Termination

Welinkup may suspend or terminate your access to the Service at any time, with or without cause, including if:

Your use of the Service poses a security risk or negatively impacts other users.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any

disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation.

If negotiation fails, disputes shall be submitted to the competent courts of Marrakech, Morocco.

15. Changes to Terms

Welinkup reserves the right to modify these Terms at any time. We will notify you of material changes by email

or through the Service at least 30 days before the changes take effect. Your continued use of the Service after

the effective date of the updated Terms constitutes your acceptance of the changes.
